The Ministry of Justice announced that the new Civil Code shall come into force on October 1st 2011.
As of October 1st 2011, we provide counselling on matrimonial patrimony planning for marriages concluded before October 1st 2011 and marriages that are due to be concluded.
Spouses shall be able to choose among several matrimonial regimes, that is, community of assets, separation of assets, participation in acquisitions, thus benefitting from specialised guidance in order to find the solution that best fits their situation.
Matrimonial conventions shall only be concluded in authenticated form by a notary public and shall be registered in a National Register.
The Fiduciary (also called trust) shall only be created by way of contract authenticated by a notary public, once the new Civil Code comes into effect.
From the same date, notaries may be appointed as fiduciaries, that is, persons called to administer the fiduciary assets that belonged to the creator of the trust, with a clearly cut purpose, to the benefit of one or several beneficiaries. This role may also and exclusively be performed by credit institutions, financial investment institutions, insurance companies and lawyers.
