Amicable divorces and asset division between spouses
Since October 1st 2011, spouses may divorce by agreement in front of a notary, whether they have children or not.
Our office may accept spouses who signed their marriage in Bucharest or have their last common domicile, as shown by the identity documents or by an authentic declaration, in the municipality of Bucharest.
Couples without children will provide the identity papers, the spouses’ birth certificates, the marriage certificate.
Couples with underage cildren shall provide the identity papers, the spouses’ birth certifictes, the marriage certificate, the children’s birth certificates.
The request for a social investigation is made by the notary’s office, with no additional cost. Children over 10 years of age shall be heard by the notary during the divorce procedure.
Spouses must agree upon the following aspects, which shall be recorded into an authentic agreement : the name the wife shall have after the divorce (if she had changed her name upon marrying), the fact that parental authority shall be exercised jointly, with which parent will the children reside, the holiday and visitation schedules, the contribution of the separate parent to the raising and education of the children.
Spouses may decide to divide their assets both during the marriage and at the date of the divorce. Assets division requires ownership documents. Fiscal certificates and land register records are to be obtained by the notary’s office, after the beginning of the procedure.
