Successions

Depending on the deceased’s last habitual residence, the notary’s jurisdiction is established.
Notaries from Bucharest may debate successions of deceased persons that had their last habitual residence (the one mentioned in the death certificate) in Bucharest.
The succession file is opened at the request of one of the inheritors.The other inheritors must also be indicated in the request, with their full domicile, in order to be subpoenaed.
If the inheritors cannot agree on the succession, it shall be declined to a court of law.
Documents necessary to open a succession:

  1. Death certificate ( original)
  2. Civil status acts: birth certificates and marriage certificates of the inheritors
  3. The ownership acts for the assets of the succession/estate
  4. Fiscal attestation certificate from the deceased’s domicile for automobiles
  5. Two whitnesses
  6. Inheritors must be present or may be represented by means of an authenticated power of attorney.

Depending on the particularities of each case, other documents may be requested. According to the Fiscal Code, successions debated within two years since the date of death are exempt from the succession tax, as far as immovable assets of the succession are concerned.
If the succession is debated after this deadline, inheritors shall pay to the state 1 percent of the value of the succession’s immovable assets, plus the notary fee.
Immovable assets are evaluated according to the guidelines valid for each calendar year.
Upon completion of the procedure, the parties shall each receive an inheritor’s certificate.
If the succession does not contain any assets, but the parties need to prove their quality in a court trial, for example, a certificate stating the quality of inheritor may be issued.
