Wills
The will is a unilateral juridical act that contains both patrimonial provisions and non-patrimonial ones – such as appointing a will executory , recognition of a child, funeral arrangements.
The will is a very efficient instrument to insure the wish of its author is respected, and it only produces property transfer effects upon his/her death.
The will can be revoked at any moment by authenticated declaration or by another will, made by the author only.
It may be seen as an instrument to protect the surviving spouse, gratifying persons not related to its author, etc.
In order to authenticate a will, a person shall go to a notary with a project of the will, or shall dictate his/her wishes to the notary.
For the authentication of the will, the presence of two whitnesses is reccomended. They will be brought along by the will’s author and shall attend the reading and signing of the will. Whitnesses shall be identified by valid identity card and shall also sign the will.
